How do you know whether you might have a successful claim for negligence?

You may have been a victim of dental negligence if the treatment you have been given by your dentist has fallen below the standard you should expect from a medical professional. For example, have they missed signs of gum disease that another dentist has picked up immediately? Has something gone wrong with your orthodontics or cosmetic dentistry that you weren’t expecting, or told to expect?

If my dentist has been negligent, how long will it take to make a claim?

It really depends on the severity of the case, and whether the dentist admits liability. However, usually cases take between one and three years.

How much compensation do you usually get for dental negligence claims?

Compensation is awarded based on financial losses, and for pain and suffering as well. These are known as special damages and general damages. Usually, you will claim the amount it would cost to have the issue caused by negligence fixed. For example, if you had serious periodontal disease (gum disease), you may require your teeth to be removed and replaced with implants.;  we have had cases where this treatment has cost over £100,000. On top of this, as mentioned, you will be compensated for the pain you have suffered as a result of the negligence, this is calculated by guidelines set by the Court

Can you sue a dentist who has retired?

Sometimes clients come to us after a new dentist has identified a problem that has been missed for many years by a newly-retired dentist.  Even if the dentist is retired, we are still able to sue the dentist and claim against their insurance policy, as the policies are retrospective.

Dental negligence can cause completely unnecessary pain and suffering to patients who have paid to have their teeth looked after. If you think that you might have suffered as a result of your dentist’s negligence, get in touch today for a free, no-obligation chat about what you can do.
